OUR POLICY ON USING YOUR PERSONAL DATA

We, TOKYO OHKA KOGYO CO., LTD. Europe Branch (“Europe Branch”), take privacy very seriously and undertake to process your personal data in compliance with applicable privacy laws including the EU General Data Protection Regulation (“GDPR”). Below is our policy on how we process personal data of the website visitors, employees of our customers and suppliers and other third parties.

Europe Branch is the “data controller”. This means that we are responsible for deciding how we collect and process your personal data. We are required under the GDPR to notify you of the information contained in this privacy statement.

We may modify, add to, or delete part of this policy from time to time.

HOW WE USE YOUR PERSONAL DATA

You disclosed to us your personal data such as your name, company you belong to, your position and business contact details by handing over to us your business card and/or through our communication face-to-face, in meetings, over the phone, etc. We base our legitimate commercial interest as the legal ground to process them for the following purposes:

  • sharing them within Europe Branch (i) to provide more useful information, more relevant content and offers, and latest news about our products, solutions, services and events, (ii) to provide, protect and improve our products and services, and (iii) to help solve any issues you might have with our products and services.
  • Sharing them with our global headquarter, TOKYO OHKA KOGYO CO., LTD. (“TOK”), Japan and its subsidiaries (“Tokyo Ohka Kogyo Group”) in the context of reporting our business activities to fulfill and support the purposes of processing within Europe Branch described above.
  • storing, organizing and referring to them for our future communication with you on the subject related to our prospective business with you.
    We will not use your personal data without your consent for any other purposes than those above. In case we would want to process your personal data for other purposes we shall ask your explicit consent to do so.

 

HOW LONG WE KEEP YOUR PERSONAL DATA

We will keep your personal data as long as may be necessary for the purposes described above or until you withdraw your consent or object to the use of your personal data unless keeping the data is a legal obligation for Europe Branch.

WHOM WE SHARE YOUR PERSONAL DATA WITH

We may share your personal data with Tokyo Ohka Kogyo Group and our service providers who support our business, such as providing technical infrastructure services.
We will not disclose your personal data to anybody else, unless we are legally obliged to do so, or to protect your vital interests.

TRANSFERS TO COUNTRIES OUTSIDE THE EEA

When we share your personal data with Tokyo Ohka Kogyo Group and our service providers, we may transfer your personal data to Japan and other countries, where European data protection laws including the GDPR are not in force. The European Commission has decided that Japan and some other countries or territories ensure an adequate level of data protection, and that personal data can be lawfully transferred to those countries or territories without requiring any specific authorization. Your personal data are protected by the Data Transfer Agreements (EU’s standard contractual clauses) when your personal data are transferred to Tokyo Ohka Kogyo Group and our service providers outside the EEA without the adequate level of data protection. These Agreements impose contractual obligations equivalent to those imposed by the GDPR to protect your rights with your personal data. YOUR LEGAL RIGHTS

You have legal rights to request from us the following:

  • access to your personal data and to certain supplementary information covered by this notice;
  • rectification of your personal data if inaccurate or incomplete;
  • erasure of your personal data (‘right to be forgotten’) in certain circumstances;
  • restriction of processing your personal data in certain circumstances;
  • objection to processing your personal information in a certain circumstances;
  • withdrawal of your consent as far as we process your data based on your consent;
  • obtaining a file with your personal data in a structured, commonly used, and computer-readable format and transmitting those data to a third party (‘right to data portability’) in certain circumstances.

You can lodge complaints about our way of processing your personal data with data protection supervisory authorities.
